By accessing or using this Site, you (“you” or “User”) agree to be bound by these Terms of Use, Privacy Policy, and Legal Disclosures (collectively, “Agreement”). If you do not agree, do not use this Site.

SanDiegoSailing.com provides informational resources, links, and directories related to the San Diego sailing community, including but not limited to: sailing charter businesses, local marine services and businesses, and crew-connection pages that help match available crew members with boat owners and skippers. The Site may also provide referrals to third-party businesses.
3. Disclaimers & Limitation of Liability
No Warranties. This Site and all content, information, links, resources, crew listings, referrals, and recommendations are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Third-Party Links & Referrals. This Site contains links to third-party websites, businesses, and services. We do not control, endorse, or assume responsibility for the content, products, services, privacy practices, or safety standards of any third-party site or business. Your interactions with any third-party, including charter operators, marine service providers, and any businesses discovered through this Site, are solely between you and that third party.
Crew Connection Disclaimer. The crew-connection pages on this Site are provided as a community resource to help connect crew members with boat owners and skippers. We do not verify, screen, vet, or endorse any users of the crew pages. We make no representations regarding the qualifications, experience, certifications, reliability, or character of any individual listed on or using these pages. You assume all risk when engaging with individuals through the crew-connection features. We strongly recommend that all parties independently verify credentials, experience, and references before entering into any arrangement.
No Professional Advice. Nothing on this Site constitutes professional, maritime, legal, financial, or safety advice. All sailing and boating activities carry inherent risks, including risk of serious injury or death. You are solely responsible for exercising appropriate judgment, following all applicable maritime laws, maintaining proper safety equipment, and ensuring adequate insurance.

If you submit any content to the Site (including crew listings, comments, or other information), you grant SituFix Ventures LLC a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, display, and distribute such content in connection with the Site. You represent that any content you submit is accurate and does not violate any third party’s rights.
6. Affiliate & Referral Disclosure
This Site may earn referral fees, commissions, or other compensation when users click on links to or engage with third-party businesses featured on the Site. This compensation may influence which businesses or links appear on the Site and in what order. This does not affect our commitment to providing useful resources to the San Diego sailing community.
7. Intellectual Property

We respect intellectual property rights. We may collect personal information you voluntarily provide (such as name, email address, and sailing experience when submitting crew listings or contacting us), as well as automatically collected data such as IP addresses, browser type, device information, pages visited, and referring URLs.
How We Use Information. We use collected information to operate and improve the Site, facilitate crew connections, respond to inquiries, and analyze Site usage.

10. Dispute Resolution & Binding Arbitration
Informal Resolution. Before initiating formal dispute resolution, you agree to contact us and attempt to resolve any dispute informally for at least 30 days.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Site that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration shall take place in San Diego County, California, or at another mutually agreed location. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found unenforceable, the entirety of this arbitration provision shall be void.
Small Claims Exception. Either party may bring an individual action in small claims court in lieu of arbitration.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
12. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. Entire Agreement
This Agreement constitutes the entire agreement between you and SituFix Ventures LLC regarding your use of SanDiegoSailing.com and supersedes all prior agreements and understandings.
